TEL-ONE (Pvt) Ltd has dragged a Bulawayo college to court demanding payment of $24,000 in unpaid telephone bills. The company filed summons at the Bulawayo High Court citing Business Environment Services (BES), its directors Obert Sibanda and his wife Rosemary Sizwe as defendants. The telecommunications firm is seeking an order compelling Sibanda and his wife to settle a debt of $24,812,42 for services rendered between January 2009 and January 2013. The company in its the summons said despite demand, the college has deliberately, ignored, refused and neglected to pay the money despite demand.
“During the period between January 2009 and January 2013, the plaintiff rendered telephone services to the first defendant (BES) at its own instance. The cost for services rendered amounts to $24,812,42. The second defendant (Sibanda) and third defendant (Rosemary) bound themselves as co-principals and guarantors for payment of any outstanding amount,” said the company.
The company is demanding payment with interest at a prescribed rate and the cost of suit.
BES has not yet filed a notice to enter an appearance to defend the summons.
In July BES was also involved in another legal battle with Tyre House Building challenging its eviction from the property over unpaid rentals amounting to more than $100,000.
BES filed an application for rescission of a default judgment handed down in June by Justice Lawrence Kamocha in favour of the owners of the building, Tyre House Building.
